APPLICATIONS TO REOPEN

In certain circumstances where an individual is prevented from adequately presenting his/her case, the person may be eligible for applying to reopen his/her case. This is based upon a very simple principle that is fundamental to the Canadian legal system, namely, the right to be heard. In the legal jargon, these are called cases in which there has been a “failure of natural justice” which enables the person to ask/request the reopening of his case.
